1. Acceptance of Terms

By creating an account, signing in, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Description of Service

Desi POS is a business management platform that provides:

• Retail billing, inventory management, and multi-branch operations
• Radiology worklist management (X-Ray, CT, MRI, USG, Mammography, and more)
• DICOM image viewing and AI-assisted report generation
• Patient management and appointment booking
• ABHA (Ayushman Bharat Health Account) integration — coming soon
• Hardware integration with Bluetooth printers, scanners, and label printers
• Payment processing via Razorpay

3. Eligibility

You must be at least 18 years of age and authorized to represent the business or organisation on whose behalf you are using the Service. The Service is intended for business use only and is not for personal or household use.

4. Account Registration and Security

• You must register with valid business credentials. Providing false information is prohibited.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must notify us immediately of any unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to:

• use the Service for any unlawful purpose or in violation of any applicable laws or regulations;
• upload or transmit malicious code, viruses, or harmful data;
• attempt to gain unauthorized access to any part of the Service or its infrastructure;
• reproduce, duplicate, copy, sell, or exploit any part of the Service without prior written permission;
• use the Service to store or process data in a way that violates patient privacy or applicable healthcare regulations.

6. Healthcare Data and Radiology

The radiology and patient management features of the Service involve sensitive health information. You agree that:

• All patient data entered into the Service must be done with the patient's knowledge and consent where required by law.
• You are responsible for ensuring that your use of the Service complies with applicable healthcare regulations, including ABDM (Ayushman Bharat Digital Mission) guidelines.
• Radiology reports generated or assisted by AI are for reference only and must be reviewed and validated by a qualified radiologist before clinical use.
• We are not liable for any clinical decisions made based on data processed through the Service.

7. Payments and Billing

• Payment processing is handled through Razorpay. By making payments through the Service, you agree to Razorpay's terms of service.
• All fees are in Indian Rupees (INR) unless otherwise specified.
• We reserve the right to change pricing with reasonable notice.
• Refunds are handled on a case-by-case basis at our discretion.

8. Intellectual Property

All content, software, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, and code — are the exclusive property of SRR Diagnostic Center Owner and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without prior written consent.

9. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described therein.

10. Availability and Uptime

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We shall not be liable for any loss caused by unavailability of the Service.

11. Limitation of Liability

To the maximum extent permitted by law, SRR Diagnostic Center Owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

12. Indemnification

You agree to indemnify, defend, and hold harmless SRR Diagnostic Center Owner and its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine violates these Terms, applicable law, or is otherwise harmful to users, third parties, or the Service. Upon termination, your right to use the Service ceases immediately.

14. Changes to Terms

We may update these Terms from time to time. Changes will be posted with an updated effective date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of India.
